Scope: The course aims to investigate any cases of extra contractual liability that may arise from within the family, applying such notion in the broad sense, including relationships which are based on marriage, but also those related to relationships I difficulty and more uxorio cohabitation.
Building on the analysis of breach of the marriage promise, the course will treat the topic of responsibility for marital infidelity or for non-fulfillment of other obligations deriving from marriage, with a close focus on the following cases: infringement of the regulations on joint physical care, violence and abuse by parents on their children, non-payment of monetary penalties in the sphere of separation judgments, rupture of the more uxorio cohabitation and, obviously, the instruments introduced by Law no. 54/2006 (Art. 709 ter of the Italian Civil Code).
An analysis will also be conducted on cases concerning parental responsibility for the illicit acts of their children, focusing on the nature of this type of offence and on the consequences of cases concerning separated parents in relation to the type of physical care judicially or consensually established. Particular attention will be given to the criteria for attributing responsibility and to the parents’ exonerating circumstance.
Specific sessions will be dedicated to the subject of offence due to the death of one’s father or relative, and to identifying the procedures adopted in the courts concerning the an debeatur and quantum.
Aim: Providing in-depth knowledge of the particular segment of extra contractual liability concerning the family (in the wide sense) sector.
Method: The traditional face-to-face presentations will be combined with the analysis of practical cases, and study groups will also be formed to tackle the issue of offence due to the death of a relative with the aim to identify the settlement techniques.
Candidates: magistrates performing functions in civil matters; also, a 15% share is reserved for ordinary magistrates appointed through Ministerial Decree October 2, 2009. The course is open to the participation of private practice attorneys.
