UPGRADE OF CATALOGUE ACTIVITIES 2011 – FULL SEMINAR SCHEDULE

Civil Torts and the Family 

  • Schedule:  10-12 October 2011

Scope: The course aims to investigate any cases of extra contractual liability that may arise from within the family, applying such notion in the broad sense, including relationships which are based on marriage, but also those related to relationships I difficulty and more uxorio cohabitation.

Building on the analysis of breach of the marriage promise, the course will treat the topic of responsibility for marital infidelity or for non-fulfillment of other obligations deriving from marriage, with a close focus on the following cases: infringement of the regulations on joint physical care, violence and abuse by parents on their children, non-payment of monetary penalties in the sphere of separation judgments, rupture of the more uxorio cohabitation and, obviously, the instruments introduced by Law no. 54/2006 (Art. 709 ter of the Italian Civil Code).

An analysis will also be conducted on cases concerning parental responsibility for the illicit acts of their children, focusing on the nature of this type of offence and on the consequences of cases concerning separated parents in relation to the type of physical care judicially or consensually established. Particular attention will be given to the criteria for attributing responsibility and to the parents’ exonerating circumstance.

Specific sessions will be dedicated to the subject of offence due to the death of one’s father or relative, and to identifying the procedures adopted in the courts concerning the an debeatur and quantum.

Aim: Providing in-depth knowledge of the particular segment of extra contractual liability concerning the family (in the wide sense) sector.

Method: The traditional face-to-face presentations will be combined with the analysis of practical cases, and study groups will also be formed to tackle the issue of offence due to the death of a relative with the aim to identify the settlement techniques.

Candidates: magistrates performing functions in civil matters; also, a 15% share is reserved for ordinary magistrates appointed through Ministerial Decree October 2, 2009. The course is open to the participation of private practice attorneys.

Conference on the European Union Criminal Justice

  • Promoter: ERA in cooperation with the Polish Ministry of Justice in the framework of the Polish Presidency of the Council of the EU.

Objective: The objective of the annual conference, organised under the auspices of the Polish Presidency of the EU, is to facilitate the exchange of experiences and ideas among legal practitioners on current developments and future initiatives in the field of EU criminal justice. Experts from the EU and the Member States will debate the changes brought about by the Lisbon Treaty and the Stockholm Programme in this field of law.

  • Issues concerning the transitional period for changes brought about by the Lisbon Treaty and when the changes will occur in practice
  • The protection of fundamental rights and the impact of the Lisbon Treaty on procedural safeguards in criminal proceedings

Different Manifestations of Corruption and how to combat them

This conference is targeted at criminal court judges, as well as public prosecutors, who have been dealing with this area of crime for some time. The following topics in particular will be addressed in lectures, discussions, podium discussions and working groups:

  • Investigative tactics and the specifics of procedural measures

International parental child abduction – international judicial cooperation in matters of illegal taking and retention of children

Improving participants’ knowledge regarding the practical application of the relevant international instruments relating to illegal taking and retention of children

Approach to the Council Regulation (CE) nº 2201/2003, regarding competence, recognition and execution of sentences about parental responsibilities and matrimony, and The Hague Convention of 1980 about the civil aspects of international child abduction.

Judicial cooperation in criminal matters in the EU - finding common grounds

  • Schedule: 1-2 November 2011  
  • Venue: National Institute of Magistracy, Bucharest

The seminar is opened to judges specialised in criminal matters and to public prosecutors. During the seminar the participants will be working with the key criminal law terminology provided for by EU Treaties and EU law secondary legislation through several legal and language exercises conducted by legal experts and linguists.

The seminar will cover topics as:

  • The European Arrest Warrant
  • Mutual legal assistance
  • Council Framework Decision 2006/783/JHA of 6 October 2006 on the application of the principle of mutual recognition to confiscation orders
  • Directive 2010/64/EU of the European Parliament and of the Council of 20 October 2010 on the right to interpretation and translation in criminal proceedings.

A special emphasis will be laid on interactive debates, free expression of opinions and the presentation of the national experience concerning each topic.

International aspects within the spheres of Civil Litigation

The growing number of disputes involving international elements within the spheres of personal law, family law, contract law and liability law are increasingly causing magistrates to question the jurisdiction and applicability of relevant laws.

In parallel, the number of international legal instruments is also increasing, affecting international and European bilateral norms, European case law and the internal rules of conflict of laws.

The session aims to address the different areas where conflicts of law arise and to provide judges and prosecutors benchmarks to facilitate their own search for solutions tailored to the specific situations they are dealing with.

Pedagogy:
Based on the legal analysis of the fundamental principles involved, lectures/speeches from judges and academics as well as the views of experts in these matters, this session will give the possibility for participants to enrich their own thoughts and share their concerns.
